List of Prohibited and Restricted Items


Though you can sell any items on ReferApps, some categories of products are restricted or banned from being listed. Here are the items that are not allowed to be in a seller's listings.

NOTE: If you supply products for sale on ReferApps, you must comply with all federal, state, and local laws and ReferApps policies applicable to those products and product listings.


Items that are Prohibited and Restricted


Adult Items


Allowed in Listing

    ● Prophylactics and other over-the-counter contraceptives (pre-approval not required)

    ● Unrated erotic videos and DVDs

    ● Magazines widely available in non-adult-only bookstores

    ● Sexual health products listed by pre-approved sellers

    ● Sexual aid devices listed by pre-approved sellers

● Adult-only novelty items listed by pre-approved sellers, such as:

    ● Novelty food items

    ● Soaps

    ● Vibrators


Not Allowed in Listing


● Products that portray nudity in a gratuitous or graphic manner, such as:


    ● Amateur pornography

    ● Pornography

    ● X-rated movies

    ● Sexual health products unless listed by pre-approved sellers

    ● Sexual aid devices unless listed by pre-approved sellers

    ● Adult-only novelty items unless listed by pre-approved sellers

    ● Media featuring Traci Lords created prior to May 7, 1986


Alcohol


Allowed in Listings


● Wine sold by pre-approved sellers

● Wine and beer making kits and products that do not contain alcohol

● Alcohol-related products and accessories (including corkscrews, decanters, and

containers)

● Alcohol-related memorabilia and collectibles that do not contain alcohol

● Foods with alcoholic ingredients and flavoring (such as liquor-filled chocolates, rum

cake, and other items) as long as the item is not included in the list of prohibited food

● Hops, seeds for hops, and other raw materials to make beer or wine

● Non-alcoholic or de-alcoholized beer and wine


Not Allowed in Listings

● Alcoholic beverages (except pre-approved wine sellers)


● Liquor licenses

● Products that contain raw alcohol

● Any product marketed for customers over 21 years of age


Wine Buyers

Before a buyer can purchase wine on ReferApps from pre-approved sellers, they must first meet

the following requirements:

● Buyer should at least be 21 years old

● If the wine will be received on behalf of the buyer, the buyer must make sure that the

recipient is at least 21 years old

● Make sure that the transaction follows all interstate commerce laws, including all laws

around shipping and fulfillment

Buyers, by purchasing these items, authorize and represent that they are aware of and are in

compliance with their own state laws and regulations


State laws

Every state in the US has different laws for the sale of wine, especially when dealing with wine

sales across state borders. Members should fully research and understand federal and state

laws before listing wine. If you want to sell wine, you should also take the time to review state

shipping restrictions that are in the Requirements for wine-related transactions on ReferApps

section below. The Wine Institute is a great place to find more information on the laws for selling

wine.


Requirements for wine-related transactions on ReferApps

Be sure to meet all the following terms and conditions when buying or selling wine on

ReferApps. These terms and conditions may change over time. It is your responsibility to visit

these pages to see if and how it may have changed so that you can remain compliant.

1. Limitation of liability: Both buyer and seller expressly acknowledge and agree that

ReferApps shall not be liable for any special, incidental or consequential damages or lost


profits (however arising, including negligence) resulting from or in connection with the

sale of property on the ReferApps site.

2. Representations and warranties:

Each seller represents and warrants that:

● The seller of the wine has the right, power, and authority to sell the wine

● The owner of the wine owns all necessary and required licenses to lawfully carry out

wine-related transactions on our site, and ship the item to its purchaser

● The recipient (and buyer if different from the recipient) has proven he or she is 21 years

of age or older prior to delivery

● The transaction will comply with all interstate commerce laws, including all laws around

shipping and fulfillment

Each buyer represents and warrants that:

● The buyer of the wine is at least 21 years old

● The recipient of the wine is at least 21 years old

● The transaction will comply with all interstate commerce laws, including all laws around

shipping and fulfillment

3. Indemnification: The seller is solely responsible for compliance with all laws associated

with the sale of wine. The seller indemnifies ReferApps of all responsibility associated

with this sale. It is, therefore, the seller's sole discretion of the completion of the

transaction based on its ability to assure that the transaction is in compliance with all

laws associated with the sale of alcohol.

4. Shipping: Certain local, state, and federal laws and regulations govern and limit a

seller's ability to sell and ship wine and other alcohol. As a seller, you are solely

responsible to consult with legal and/or other experts to determine which laws and

regulations may impact your activities and to fully abide by those laws and regulations.

Since each state has its own regulations governing the shipment of wine, the seller must

clearly note which states it is able to ship to in the item description.

5. Age: Wine shipped by seller requires the recipient to be in possession of photo

identification confirming they are 21 years of age or older. Buyer, if different from the

recipient, must also show proof of age.


Shipping Alcohol for Pre-Approved Sellers

There are carriers that do not allow the shipment of intoxicating liquors. For example, the US

Postal Service doesn't allow intoxicating liquors that contain 0.5% or more alcohol by content.

Though there are carriers such as FedEx and UPS may allow these items to be shipped, but

you should check their rules and regulations before offering their shipping services in your

listing.


Animals & Animal Products


Allowed in Listings

● Live shellfish and crustaceans

● Live insects and worms used for agricultural purposes, bait, or pet food

● Products made to resemble prohibited animal parts or products, but which are not made

from those animals. If the listing includes a clear title and description that the item is not

genuine; for example, faux tortoise shell is permitted if the listing states the item is fake

or artificial.

● Animal parts or products that are not otherwise restricted, such as:

○ Shark teeth jewelry


Not Allowed in Listing

● Animal feces

● Most live creatures, such as pets, livestock, or marine mammals

● Illegal wildlife products

● Fish or wildlife that are taken, possessed, transported, or sold in violation of the Lacey

Act

● Insects or other creatures designated as "plant pests"


● Parts or products, including fur and feathers, from federally endangered or threatened

species, such as:

○ Cheetah

○ Jaguar

○ Leopard

○ Mountain zebra and Hartmann mountain zebra

○ Sable antelope

○ Tiger

○ Polar bear

○ Ocelot

○ Wolf

○ Indian python

○ Crocodile

○ Alligator

○ Sea turtle

○ Colobus monkey

● Parts or products from bear or mountain lion; such as:

● Vaccines (including human and animal vaccines), such as:

○ Rabies

● Products that contain parts or ingredients derived from sharks, whales, dolphins, or

porpoises (with the exception of teeth, which are permitted), such as:

○ Joint pain supplements containing shark cartilage

○ Shark fin products

○ Shark liver oil

○ Whale meat

● Products that contain foie gras may not be shipped to addresses within the State of

California.

● Parts or products made from certain species listed below may not be shipped to

addresses within the State of California:

○ Cobra

○ Python

○ Kangaroo


○ Feral horse

○ Porpoise


Art Selling


Allowed in Listing

● Selling your own original work

● Selling exact replicas or reproductions of artwork if the listing includes the word

"reproduction" in the title and the description

● Genuine artwork for which the seller has and can provide evidence of authenticity

● Artwork for which the seller clearly and prominently discloses its condition, alterations,

and conservation or repairs in the listing description


Not Allowed in Listing

● Knowingly selling, exhibiting, trading, producing or advertising any unauthorized copy or

reproduction of any work of art

● Disclaiming knowledge of, or responsibility for, the authenticity or legality of an item that

you describe as genuine

● Describing or marketing any item as genuine if you cannot provide reasonable evidence

to prove its authenticity

● Knowingly participating in any way in the advertisement or sale of any work of art using

any deceptive practices, including, but not limited to, false or misleading claims of the

item's scarcity, value, provenance, condition or investment potential

● Unauthorized copies or reproductions of artwork that violate any copyright or trademark

NOTE: You must abide by all laws relating to the sales of works of art and assist in the

prosecution of violators of the law in this respect


Artifacts, cultural heritage, and grave-related items


Not Allowed in Listing

● Items that are not authentic

● Items without provenance or ownership history of the object

● Items that are not approved for import or export

● Looted or stolen goods. The International Council of Museums' Red List identify

categories of cultural goods most vulnerable to illicit traffic

● Authentic artifacts, fossils, and relics that are not clearly stated it was a reproduction

● Artifacts, fossils, or relics taken from any of the following places:

○ Federal or state public land

○ Native American land or battlefield

● Listings for government survey markers (like those used by the U.S. Geological Survey)

unless have proof of transferred ownership to the seller. This proof can be either a photo

or a scanned image of the document

● Speleothems, stalactites, and stalagmites took from caves on federal land

● Describing items in the following terms because they make it hard for buyers to find

authentic versions:

○ Alaska Native style

○ American Indian style

○ Native American style

○ Other descriptions that may suggest the item was made by a Native American

● Items not made by Native Americans can't be listed in Native American categories

● Unknown artisan or tribal affiliation for arts and crafts made in 1935 or later can't be

described as Alaska Native, American Indian, or Native American


● Items from Native American or Native Hawaiian grave sites, such as:

○ A funerary object placed with the dead

○ Grave marker

○ Human remains

● Sacred items used by Native American religious leaders in ceremonial practices, such

as:

○ Ceremonial Masks

○ Prayer sticks

● Items listed in the Non-Native American Crafts category described as:

○ Alaska Native style

○ American Indian style

○ Native American reproduction

○ Native American style

○ Other descriptions that may suggest the item was made by a Native American

● Items that were taken from historical grave sites like battlefields, protected lands, or

shipwrecks

● Used funerary items like headstones, markers, or urns

● Items listed in the Non-Native American Crafts category described as:

○ Alaska Native style

○ American Indian style

○ Native American reproduction

○ Native American style

○ Other descriptions that may suggest the item was made by a Native American

● Items that were taken from historical grave sites like battlefields, protected lands, or

shipwrecks


● Used funerary items like headstones, markers, or urns


Laws

Any restriction or ban on selling these items is generally based upon various laws that we need

to follow, including:

● The Indian Arts and Crafts Act

● The Native American Graves Protection and Repatriation Act

● The Federal Cave Protection Act


This policy also reflects regulations that have been set by various government agencies in the

U.S, including the U.S. Bureau of Indian Affairs (BIA), the Federal Bureau of Investigation (FBI),

the U.S. Department of Agriculture (USDA), and the U.S. Department of the Interior (DOI).

As part of the fight against the traffic of stolen works of art, Interpol encourages not only law

enforcement agencies, but also art and antique dealers and owners of works of art to play an

active role in the exchange of information about stolen works of art. You can find more

information and resources on the Works of Art section of the Interpol website.

Make sure your listing follows these guidelines. If it doesn't, it may be removed, and you may be

subject to a range of other actions, including restrictions of your buying and selling privileges

and suspension of your account.


Autographed items

Autographs are commonly sold with Certificates of Authenticity (COA) or letters of authenticity

(LOAs). COAs and LOAs can offer assurance that an autograph is genuine, but you need to be

sure the authenticator is reputable. Before listing an autograph item, be sure to include the

following information in your listing:

● A clear photo of the actual autographed item

● A clear photo of the COA or LOA


● Information about the COA or LOA, including the name of the person or company

issuing the certificate

● Refund policy, in case a reputable dealer informs us or the buyer that the item is "likely

not authentic"

● Authentic and authorized pre-printed autographs or autographed items should generally

be listed in the Autographs-Reprints category. An authorized pre-printed autograph

means a company has acquired the rights to accurately reproduce the originally signed

item


Not Allowed in the Listing

● Autographed items with COAs and LOAs, or references to COAs and LOAs from the

following people or organizations:

● Motor vehicles that are required to be registered

● Photo-blocker sprays or license plate covers designed to block detection by red light

cameras, toll both systems, police cameras, or other photodetection sources

● Products intended to defeat, bypass, or shut down emission control devices, including

oxygen simulators and CAT, DPF or EGR delete kits

● Products intended to override malfunction indicator lights

● High-intensity discharge (HID) conversion kits

● Used Tires

● Products intended to affect traffics signals

● Products designed to intentionally block, jam, or interfere with licensed or authorized

radio communications, such as:


○ Cell jammers

○ GPS jammers

○ Laser jammers

○ PCS jammers

○ Radar jammers

● Products intended to alter odometers

Cosmetics & Skin/Hair Care


Before listing cosmetics, the seller must comply with these checklists to ensure the credibility of

the product.


Packaging

● Cosmetics must be sealed in the original manufacturer’s packaging

● Cosmetics must be new and unused


● Supplements must clearly display identifying codes placed on the packaging by the

manufacturer or distributor, such as matrix codes, lot numbers, or serial numbers


Labeling

● Cosmetics must be labeled in English with the following information:

○ The name of the product

○ The purpose or use of the product (e.g. cleansing the body, reducing the

appearance of wrinkles, moisturizing the skin)

○ The amount of content of the cosmetic, in terms of weight, measure, count or a

combination (e.g. 30 oz, 5 mL, 10 pills, 5 lbs)

○ The ingredient list

○ The name and address of the manufacturer, packer, or distributor

○ Any necessary label warnings

● Cosmetic labels must not state that the products cure, mitigate, treat, or prevent a

disease in humans unless that statement is approved by the FDA

● Cosmetic labels must not state that the cosmetics are “FDA approved” if they are not

FDA approved

● Cosmetic labels must not use the FDA logo

● Cosmetic labels should not state “tester,” “not for retail sale,” or “not intended for resale”

as such items may not be sold on ReferApps


Detail Page

● Detail pages must include the following information:

○ The name of the product

○ The purpose or use of the product (e.g. cleansing the body, reducing the

appearance of wrinkles, moisturizing the skin)


○ The ingredient list, including an image of the ingredient list from the product label

○ Any necessary label warnings

● Detail pages must not state that the products cure, mitigate, treat, or prevent a disease

in humans unless that statement is approved by the FDA

● Detail pages must not state that the cosmetics are “FDA approved” if they are not FDA

approved

● Images associated with detail pages must not include the FDA logo


Products and Ingredients

● Cosmetics must not be named in an FDA recall or safety alert (for more information, see:

Recalls, Market Withdrawals, & Safety Alerts)

● Cosmetics must not contain prohibited ingredients (for more information, see: Prohibited

& Restricted Ingredients)

● Cosmetics must be safe for use and must not be a product that the Food and Drug

Administration (FDA) has determined presents an unreasonable risk of injury or illness,

such as:

○ Products that contain methylene glycol, which, when heated, release

formaldehyde into the air (for more information, see: Hair-Smoothing Products

That Release Formaldehyde When Heated)

○ Eyelash and eyebrow permanent dye (for more information, see: Use Eye

Cosmetics Safely)

○ Eye makeup containing Kohl, Kajal, Al-Kahal, or Surma (for more information,

see Use Eye Cosmetics Safely)

○ Skin creams containing mercury (for more information, see: Mercury Poisoning

Linked to Skin Products)

○ Henna products designed or marketed for body-decorating or any other variation

of direct skin application (for more information, see: Cosmetics Safety Q&A:

Tattoos and Permanent Makeup)


● Cosmetics must not require a prescription or a medical professional's supervision or

direction for their use

● Cosmetics must not contain controlled substances, such as:

○ Anything listed in Schedules I, II, III, IV or V of the Controlled Substances Act (for

more information, see: Schedules of Controlled Substances)

○ "List I" chemicals or their derivatives as designated by the Drug Enforcement

Administration (DEA) (for more information, see: List I and List II Chemicals)

● Cosmetics must not contain plastic microbeads (for more information, see: The

Microbead-Free Waters Act: FAQs)

● In order to be sold into California and New York, antiperspirants, deodorants, and

hairsprays must not contain toxic air contaminants (for more information, see California

Air Resources Board Consumer Products Enforcement and New York Department of

Environmental Conservation)

● Cosmetics must comply with ReferApps policies, including:

○ Cosmetics that contain ingredients derived from sharks, whales, dolphins, or

porpoises are prohibited from sale

○ Cosmetics that contain more than 12% hydrogen peroxide are prohibited from

sale

○ Cosmetics that contain acetone, such as nail polish remover, cannot be sold in

volumes more than 16 oz in total

○ The products LiLash, LiBrow, and InStyler rotating irons are prohibited from sale

○ Claire’s brand cosmetics are prohibited from sale

Credit and debit cards


Before listing this type of item, you must:

● The name and part of the number on the card must be blocked out or blur if including a

picture in the listing

● Expiration date in the description and picture must be included


● Look at the terms and conditions from the issuing card company to make sure the sale

of the expired card is allowed. Some credit and debit card companies keep ownership

even after the card expires


Allowed in Listing

● Blank plastic cards, with or without magnetic strips


Not Allowed in Listing

● Currently active bank credit or debit cards

● Currently active store credit cards

● Pre-paid Visa, MasterCard, American Express, and Discover cards, regardless of the

amount on the card

● Expired bank or store cards that have been expired less than 10 years

● Cards still owned by the company or card issuer, even after the card has expired

● Non-embossed bank or store credit cards


Currency, Coins, Cash Equivalents, Stamps and Gift Cards


Without limiting the foregoing, if you qualify as a dealer of precious metals, precious stones or

jewels, you must comply with 31 C.F.R. Part 1027 and other laws and regulations applicable to

you and will, upon ReferApps' request, provide copies of your anti-money laundering program to

ReferApps.

Items considered exonumia, including but not limited to medals, medallions, challenge coins,

and commemorative coins not primarily made of a precious metal are exempt from this policy.


Allowed in Listing

● Collectible Coins


● Monetized Bullion: Coins or other forms of money manufactured of gold, silver, or other

precious metal and used now or subsequently used as a medium of exchange under the

laws of a U.S. state, the United States, or any foreign nation. The medium of exchange

must have had a legal status equivalent to legal tender that includes relevant information

known about the items:

○ Numismatic preservation

○ Country of circulation of a coin

○ Clear image of the item

○ Condition

○ Grader and Grade

○ Date of issue

○ Metal composition

○ Purity of the metal if the item is monetized bullion

○ Restrikes produced or authorized by the issuing government

● Collectible coins or monetized bullion that are reproductions, replicas, or copies and

satisfy the following conditions as well as comply with the Counterfeit Deterrence Act of

1992:

○ Marked as such on the item

○ Contain a clear image of the mark

○ State that the item is a reproduction, replica, or copy in the title and the

description


Not Allowed in Listing

● Items considered legal tender that has been altered outside of numismatic preservation.

This includes holograms, overlays, cladding, plating, or colorizing

● Paper money, including uncut sheets, bank notes, money orders, bricks, and certificates

● Imitation and prop money that is not conspicuously marked "Copy" including:


○ Coins

○ Token

○ Paper money

○ Commemorative medals

● Rounds made primarily of precious metal

● "Unsearched" bags, rolls, tubes, jars, or hoards where the buyers cannot identify clearly

the items they will receive

● Counterfeit coins and paper money such as bank notes, bonds, money orders, silver

certificates, and gold certificates

● Stocks and securities

● Equipment designed to create counterfeit items

● Cash or cash equivalent instruments, including money orders, traveler's checks, stored

value products like retail or open loop gift cards or electronic stored-value redemption

codes (except for retail gift cards listed by pre-approved sellers)

● Gift cards, including:

○ Gift cards, except retail gift cards listed by pre-approved sellers

○ Retail gift cards that exceed $2,000 in value

● Non-monetized bullion (precious metal which has been smelted or refined and has a

value dependent primarily upon its precious metal content and not upon its form)

● State or federal assistance benefits, such as:

○ Special Supplemental Nutrition Program for Women, Infants, and Children (WIC)

benefits, including supplemental foods (such as infant formula), cash-value

vouchers, and food instruments (such as vouchers, checks, electronic benefits

transfer (EBT) cards, and coupons)

○ Supplemental Nutrition Assistance Program (SNAP, formerly known as Food

Stamp Program) benefits and SNAP EBT cards


Dietary Supplements


Dietary supplements are vitamins, minerals, herbs, or other substances (like amino acids or

fatty acids) eaten to supplement the diet. They often come in forms like tablets, capsules, soft

gels, gel caps, powders, and liquids.

Supplements must be correctly described and labeled, and they must not be prohibited by

ReferApps policies. Please use the checklist below to be sure your product can be sold on

ReferApps.


Packaging

● Drugs must be sealed in the original manufacturer’s packaging

● Drugs must be new and unused

● Drugs must clearly display identifying codes placed on the packaging by the

manufacturer or distributor, such as matrix codes, lot numbers, or serial numbers


Labeling

● Drugs must be labeled in English with the following information:

Drugs & drug paraphernalia


A drug is a substance used to diagnose, cure, treat, or prevent diseases in people or animals.

Drugs can also be used to change the structure or function of the body, such as to treat some

kinds of acne. Some drugs require a prescription for sale, such as most antibiotics, while other

drugs may be sold without a prescription because they are approved by the FDA to be sold over

the counter.

“Controlled substances” are drugs that are illegal, such as cocaine or heroin. Products used with

controlled substances may be considered drug paraphernalia. Drug paraphernalia includes

products primarily intended or designed for use in making, preparing, or using a controlled

substance.

ReferApps do not allow selling narcotics, steroids, and all other controlled substances.

You also can't list drug paraphernalia, including items designed or primarily intended for use in

manufacturing, concealing, or using a controlled substance.


Packaging

Explosives, Weapons, and Related Items

ship. For example, many state laws place requirements on size, color, and markings of imitation

weapons. In addition, you are responsible for obtaining any required licenses for permitted

ReferApps prohibits the listing or sale of firearm ammunition and ammunition components for

To qualify as a ticket package, you have to sell a ticket with one of these combinations:

● At least one item or experience of significant value that relates to the ticketed
